This Mercantile Online Servicing Agreement (“Agreement”) applies to your use of the Mercantile website and the Mercantile native apps to make payments and service your Mercantile Mastercard (“Services”). This agreement is between you, and Hatch Bank and Mercantile Financial Technologies, Inc. (together “us” and “we”). Use of the Services is expressly conditioned on your acceptance of this Agreement. By using the Services, you acknowledge that you have read and agree to abide by the terms and conditions of this Agreement. If you decide not to agree to the terms and conditions discussed herein, you may not use the Services.If the terms and conditions of this Agreement conflict with the terms and conditions contained in any other Agreement solely as they apply to online payment services, this Agreement controls; provided, that the terms and conditions of this Agreement are not intended to modify any disclosures or other terms that are required by law and that are provided in any other Agreement.This Agreement shall apply regardless of the online means by which the Services are accessed, including, but not limited to, through the web site, native app, email, or on a computer, tablet, mobile device, or any other device.
Each time you initiate a payment to your credit card, you authorize us (or our agents) to initiate an electronic transfer (in the form of an automated clearing house (ACH) or other debit transaction) in your name from the bank account you specify in the amount you request, payable to us. You agree that such requests constitute your authorization to make the transfers and that you are an authorized signer on or otherwise have authorization to access the bank account you specified.
One Time Payments.
You can only make one payment per day. You can schedule as many payments in advance, to occur in the current or later billing period, but never more than one per day. You will not be permitted to schedule payments that total an amount that exceeds the then current balance on your account. Payments cannot be made on the following holidays: New Years Day (January 1), Thanksgiving Day, and Christmas Day (December 25). Other restrictions may also apply. Once a payment has been scheduled it cannot be edited but it can be cancelled.
Automatic Payments (AutoPay).
AutoPay is a feature that enables you to make payments automatically each month from the bank account you specified, by providing Mercantile a single authorization. AutoPay is available from the day after a new account completes its first billing period. You can enable AutoPay online. AutoPay will start automatically making payments in the billing period following initial setup. If you just enabled AutoPay and have a payment due in the current billing period you will need to make a one-time payment. Your authorization for AutoPay will remain in effect until you disable AutoPay. You can disable AutoPay on any day by 5:00pm Eastern Time for it to be effective on the day you disable it.
Once we have processed your online payment, you will see a reduction in your current balance, and in your current minimum payment due. However, your available credit may not be increased by the amount of your payment for up to a week. Payments made on weekends will be processed the next business day but you will receive credit for making the payment on the date you requested. The payment cut-off time for same-day online payments is midnight Eastern Time. This means we will credit your account as of the calendar day, based on Eastern Time, that we receive your payment request.
You give us the right to resubmit any payment you authorized (including an ACH debit or other electronic payment) that is returned for insufficient or uncollected funds. If any payment is returned unpaid by your financial institution for any reason, we may charge and you agree to pay a returned payment fee based on your Card Agreement up to $39.

Security of data transmission and storage
You expressly acknowledge that any wireless access to the Services may not be secure and, as such, you assume the risk associated with unauthorized access to the Services and any information contained therein, resulting from such wireless connectivity. You assume all risk that any information you download or otherwise store on your device may be accessed by unauthorized third parties. We are not responsible for the security and confidentiality of information when you: (i) use wireless connections to access the Services or download your account information, in which case you acknowledge such connection may permit other persons to access the information being downloaded, or (ii) allow other persons access to your wireless access device. You agree that any account information that you download is done at your own risk and you are solely responsible for any damage that might occur to the electronic device to which you download any information, or any loss or corruption of data that might occur as a result of the downloading or its storage on an electronic device.
